ICCPR Article 5 · ICESCR Articles 4 and 5
Someone else’s claim cannot erase your rights
Another person’s claimed right does not wipe out your rights to safety, privacy or review. Limits on rights must stay lawful and proportionate.
How you can use it
- 1If an adult says their power cancels your rights, say that is not how rights work.
- 2Ask why a health or education service was restricted.
- 3Seek review of whether the restriction is lawful.
What a violation looks like
An agency claims parental or emergency power lets it ignore a child’s privacy, safety or review.
Words you can use
“Their claimed right does not erase my rights to safety, privacy or review.”
If speaking is hard, write it, draw it, send a message, or ask a trusted adult to say it with you.
